Governing Law & Jurisdiction: These Terms & Conditions are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Orlando, Florida.

1. Acceptance of Terms

By accessing or placing an order on functionallens.com, you agree to these Terms & Conditions. If you do not agree, please discontinue use of our website immediately.

2. Eligibility & Account

Customers must be at least 18 years old to place an order. You agree to:

Provide accurate and complete information
Not use false identities
Keep your account credentials secure

We reserve the right to refuse service or cancel orders if fraudulent or suspicious activity is detected.

3. Orders & Payment

All orders are subject to availability. We accept major credit cards and payment methods supported by our checkout provider. Prices displayed at checkout include applicable sales tax when required by law.

We reserve the right to:

Cancel orders in cases of suspected fraud
Adjust pricing due to system errors
Limit quantities per customer

4. Shipping & Delivery

We ship within the United States, to all 50 states. Estimated delivery times: 3–7 business days for the continental US, 7–14 business days for Alaska and Hawaii. Shipping costs are calculated at checkout. Customers are responsible for providing an accurate delivery address; we are not responsible for delays or losses caused by incomplete or incorrect addresses.

5. Returns & Refunds

We offer a 30-day return policy starting from the date of delivery. To be eligible, items must be unused, in original packaging, in the same condition as received, and accompanied by proof of purchase. To initiate a return, email contact@functionallens.com. Returns sent without authorization will not be accepted. Once your return is inspected, we will approve or deny the refund. Approved refunds are processed within 5–7 business days to the original payment method.

6. Product Safety & Use

FunctionalLens sells eyewear (sunglasses, smart glasses, swim goggles) and vehicle accessories intended for external, everyday consumer use. Please note:

Sunglasses and swim goggles sold by FunctionalLens are not medical devices and do not replace prescription eyewear; consult an eye-care professional for vision correction needs.
Smart glasses and other electronic products contain batteries and electronic components — do not disassemble, expose to excessive heat, or submerge beyond the stated water-resistance rating. Follow the included user manual.
Vehicle mirrors and accessories must be installed so they do not obstruct the driver's view or violate state traffic regulations; installation is at the customer's own risk.
Discontinue use and consult a professional if you experience discomfort, irritation, or malfunction.
We do not make medical claims about vision correction, treatment, or prevention of any condition.
Our electronic products comply with applicable FCC requirements for devices sold in the US; certification has been verified for each SKU.

7. Limitation of Liability

To the fullest extent permitted by law, Marcia&Simone, LLC is not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business, or damages arising from misuse or incorrect application of our products. Our total liability will not exceed the amount paid for the product purchased.

8. Intellectual Property

All images, text, logos, graphics, and content on functionallens.com are owned by Marcia&Simone, LLC. Any unauthorized reproduction, distribution, or commercial use is strictly prohibited.
